Terms of Service

1. Who we are

These Terms of Service apply to fsbostudio.app and to everything we sell or provide through it. The site is run by Tar Heel Agent Resources, LLC, doing business as FSBO Studio (“FSBO Studio,” “we,” or “us”). By using the site or buying from us, you agree to these terms. If you do not agree, please do not use the site.

2. What we offer

FSBO Studio helps homeowners prepare and present their homes for sale. Our offerings include a For Sale By Owner listing guide, photo upload and editing, and related tools. Some offerings may be added over time, and anything marked Coming soon is not available yet. We may change, pause, or stop an offering at any time.

3. We are not real estate professionals

FSBO Studio provides presentation and photography help only. We are not a real estate broker or agent. We do not give real estate, pricing, legal, tax, or financial advice, and nothing on the site or in our guide should be taken as such. You are responsible for your own listing, price, disclosures, contract, and sale. Talk to a licensed professional where you need one.

4. Results are not promised

We do not promise that our guide, photos, or services will help you sell your home, sell it faster, or sell it for a certain price. Statistics we cite come from the sources named next to them. We do not control those sources.

5. Accounts

Some services need an account. Give us accurate information, keep your login private, and tell us if you think someone else is using your account. You are responsible for activity on your account.

6. Prices, Studio Credits, and payments

Prices and the number of Studio Credits each service uses are shown on the site before you pay. Payments are handled by our payment processor, and we do not see or store your full card number. Studio Credits are used to pay for services such as uploads, edits, and other tools. Studio Credit packs and digital products are not refundable once Studio Credits are used or the product is delivered, except where we choose to make an exception or where the law requires a refund. If an order fails to process on our side, we will restore the Studio Credits or refund the payment for that order.

We may change prices at any time. A change does not affect an order you already paid for.

7. Your photos and files

You keep ownership of the photos and files you upload. You give us permission to store, copy, process, and edit them, and to share them with the people and services we use to carry out your order, only as needed to provide the service you asked for. You promise that you own the photos or have the right to use them, and that they do not break any law or anyone’s rights.

We keep uploaded photos for 30 days. Previews of photos and staged images you have not bought are kept for 7 days. Photos and images you buy are kept in My Gallery for 30 days from the day you buy them. Downloading from My Gallery does not cost Studio Credits. Download and save everything you want to keep, because we may delete files after these periods.

8. AI and human editing

Edits can be made by automated tools or by people, depending on the option you choose. Results can vary, so please review every photo before you use it. Edits should never mislead a buyer. You are responsible for making sure your listing photos follow the rules of your listing site and your local MLS, including any rules about disclosing edited photos.

Turnaround times we show for human editing are targets and not guarantees. Orders submitted by 9 pm Eastern are targeted for delivery by 5 pm Eastern the next day.

9. Floor plans and partner services

Some services, such as floor plans and photo to video, are carried out with the help of partner companies. Those services may need you to install an app on your phone, follow a link we email to you, and agree to the partner’s own terms. Scan links work for a limited time. We are not responsible for services that partners provide on their own sites or apps.

10. The guide

When you get the guide, you may read it and keep and print one copy for your own personal, noncommercial use. Beyond that one personal copy, you do not receive a license to redistribute, copy, or otherwise reproduce the guide, and you may not share, resell, post, or give it to others.

11. Links and affiliate disclosure

Our site and guide include links to other companies. Some are partner links, and we may earn a commission at no extra cost to you. As an Amazon Associate, we earn from qualifying purchases. We do not control other websites and are not responsible for what they say or do.

12. Using the site responsibly

Please do not:

• Break the law or use the site to mislead others
• Upload photos or files you do not have the right to use
• Upload anything unlawful, harmful, or offensive
• Try to break into, overload, or copy the site or its systems
• Use the site to build a competing product or resell our services without our written permission

We may suspend or close an account that breaks these rules.

13. Our content

The FSBO Studio name, logo, site, and guide belong to us or our licensors and are protected by law. These terms do not give you any right to use them except as described here.

14. Disclaimers

The site, guide, and services are provided “as is” and “as available.” To the fullest extent the law allows, we do not make any promises, express or implied, including about quality, fitness for a particular purpose, accuracy, or that the site will always be available or free of errors.

15. Limit of our responsibility

To the fullest extent the law allows, FSBO Studio and its owners, employees, and partners are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost sales, or lost data. Our total responsibility for any claim related to the site or our services is limited to the amount you paid us for the order the claim is about, or $100, whichever is greater. Some places do not allow these limits, so they may not fully apply to you.

16. Your responsibility to us

You agree to cover losses and costs we face because of photos or files you upload, your listing, or your breaking these terms or the law.

17. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in North Carolina, and you agree to those courts.

18. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last changed. If you keep using the site after a change, you accept the new terms.
